1. Acceptance of Terms

These Terms of Service (“Terms”) govern your use of the Click Tickets platform, including our website https://www.Click-Tickets.com and Clover-integrated application (the “Services”).

The Services are owned and operated by AcmeTek Design LLC (“Click Tickets,” “we,” “our,” or “us”).

By accessing or using the Services, you agree to be bound by these Terms.

2. Description of Services

Click Tickets is a ticketing marketplace that enables:

  • Consumers to purchase tickets, reservations, and event-based experiences
  • Merchants and event organizers to list and sell tickets and offers
  • Location-based discovery of events and experiences

The platform is powered by software provided by Tikketfy LLC (“Tikketfy”), which acts solely as a technology provider.

Click Tickets is not the organizer, host, or owner of events unless explicitly stated.

3. User Accounts

To access certain features, users may be required to create an account.

You agree to:

  • Provide accurate information
  • Maintain the security of your account
  • Accept responsibility for all activity under your account

4. Purchases and Payments

All purchases made through Click Tickets are subject to the following:

  • Prices are set by the merchant or event organizer
  • Payments are processed through third-party payment processors
  • By completing a transaction, you authorize the charge for the total amount displayed

Click Tickets does not store full payment card information.

5. Merchant Responsibility

Merchants and event organizers are solely responsible for:

  • The accuracy of their listings
  • Delivery of services, events, or experiences
  • Honoring tickets sold through the platform
  • Customer service related to their offerings

Click Tickets does not guarantee the quality, safety, or legality of events or services listed.

6. Refunds and Cancellations

Refund policies are determined by the individual merchant or event organizer.

  • Some tickets may be non-refundable
  • In the case of event cancellation, refunds are subject to the merchant’s policy

Click Tickets may assist in facilitating refunds but is not obligated to issue refunds directly.

7. Fees

Click Tickets may charge service fees or commissions on transactions. These fees may be included in the purchase price or displayed at checkout.

8. Prohibited Use

You agree not to:

  • Use the platform for unlawful purposes
  • Misrepresent events or listings
  • Attempt to bypass payment systems
  • Interfere with platform functionality

We reserve the right to suspend or terminate accounts that violate these Terms.

9. Intellectual Property

All content, branding, and technology associated with Click Tickets are the property of AcmeTek Design LLC or its licensors.

You may not copy, modify, or distribute any part of the platform without permission.

10. Third-Party Services

The Services may integrate with third-party providers, including payment processors and Clover.

We are not responsible for the performance or policies of third-party services.

11. Disclaimer of Warranties

The Services are provided “as is” and “as available.”

We make no warranties regarding:

  • Availability or reliability of the platform
  • Accuracy of event listings
  • Merchant performance

12. Limitation of Liability

To the maximum extent permitted by law:

AcmeTek Design LLC shall not be liable for:

  • Indirect or consequential damages
  • Losses related to event cancellations or merchant actions
  • Issues arising from third-party services

Our total liability shall not exceed the amount paid by you for the specific transaction.

13. Indemnification

You agree to indemnify and hold harmless AcmeTek Design LLC from any claims arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your interactions with merchants or customers

14. Termination

We reserve the right to suspend or terminate access to the Services at any time, for any reason.

15. Governing Law

These Terms shall be governed by the laws of the United States and the State in which AcmeTek Design LLC is registered.

16. Changes to Terms

We may update these Terms from time to time. Continued use of the Services constitutes acceptance of the updated Terms.

17. Term

This Agreement begins when you first access, download, install, or use the Click Tickets platform or any related applications (the “Services”) and will continue on a month-to-month basis unless terminated by either party in accordance with this Agreement (the “Term”).

Either party may terminate this Agreement at any time upon notice, subject to any outstanding obligations, including payment, settlement of transactions, or compliance requirements that survive termination.

18. Confidentiality, Data, and Ideas

Confidentiality

Each party agrees to protect the other’s non-public, proprietary, or confidential information (“Confidential Information”). This includes, but is not limited to:

  • Business operations, financial information, and strategy
  • Customer and merchant data
  • Technical systems, platform functionality, and integrations
  • Terms of this Agreement

Confidential Information does not include information that:

  1. Is publicly available through no fault of the receiving party
  2. Was already lawfully known prior to disclosure
  3. Is independently developed without use of the Confidential Information
  4. Is received from a third party without restriction

Each party agrees to use reasonable safeguards to protect Confidential Information and only use it as necessary to perform under this Agreement.

Permitted Disclosures

Confidential Information may only be disclosed:

  • To employees, contractors, or partners who need access to perform obligations under this Agreement
  • If required by law, regulation, subpoena, or court order
  • With prior written consent of the disclosing party

Data Usage

Click Tickets may collect and use data in connection with providing and improving the Services, including:

  • Processing transactions and ticket sales
  • Supporting event operations and fulfillment
  • Fraud prevention and security monitoring
  • Analytics, reporting, and platform optimization

We may also use aggregated and anonymized data to improve our platform and services, provided such data does not identify any individual, merchant, or end user.

Feedback and Ideas

From time to time, you may provide suggestions, feedback, or ideas related to the Services (“Feedback”).

By submitting Feedback, you agree that:

  • It is  not confidential
  • Click Tickets may use, modify, or incorporate it without restriction
  • You waive any rights to compensation, attribution, or ownership

This allows us to continue improving the platform without limitation or obligation.

19. Compliance with Privacy Laws

Click Tickets is committed to complying with applicable privacy and data protection laws, including the California Consumer Privacy Act and California Privacy Rights Act (collectively, “Privacy Laws”).

In providing the Services:

  1. Service Provider Role Click Tickets processes personal information on behalf of merchants and event organizers as a service provider, and only for the purpose of delivering the Services.
  2. No Sale of Personal Information Click Tickets does not sell personal information as defined under applicable Privacy Laws.
  3. Limited Use of Data Personal information is only collected, used, retained, and disclosed as reasonably necessary to:
    • Provide the Services
    • Support transactions and event operations
    • Comply with legal obligations
  4. No Unauthorized Use We do not use merchant or consumer data for our own independent commercial purposes outside of what is permitted under this Agreement and applicable law.

20. Data Subject Rights – Assistance with Requests

  1. Cooperation with Merchants Click Tickets will reasonably assist merchants in meeting their obligations under applicable Privacy Laws, including responding to consumer requests related to access, deletion, or correction of personal information.
  2. Handling Consumer Requests If Click Tickets receives a request directly from a consumer related to data collected on behalf of a merchant, we may:The merchant remains responsible for responding to such requests.
    • Redirect the request to the applicable merchant, or
    • Assist the merchant in fulfilling the request where appropriate
  3. Support and Functionality To the extent possible within the Services, Click Tickets will provide tools or support to help merchants fulfill verified consumer requests.
  4. Notifications Click Tickets will promptly notify the merchant of any complaints, inquiries, or regulatory communications related to privacy or data protection that may impact the Services.

22. Platform Attribution

Click Tickets utilizes ticketing and marketplace software provided by Tikketfy LLC. Tikketfy acts solely as a technology provider and is not responsible for transactions, listings, or user interactions conducted through Click Tickets.
